The After Cancer Corporation (“The After Cancer,” “we,” or “us”) is committed to respecting your privacy. While we do not provide medical or clinical services, we understand that the information you choose to share with us, especially regarding your health, is deeply personal. The After Cancer is a survivorship support platform offering educational resources, wellness programming, and virtual group sessions. We are not a healthcare provider and do not offer medical advice or treatment. We are not subject to the Health Insurance Portability and Accountability Act (HIPAA) but are committed to safeguarding your data with similar care.
This Consumer Health Data Notice (“Consumer Health Data Notice”) applies to the extent required by applicable US state laws with respect to consumer of consumer health data (“Consumer Health Data”) as applicable laws may define that term. This Consumer Health Data Notice supplements our general Privacy Policy. In the event of a conflict between our Privacy Policy and the Consumer Health Data Notice, the Consumer Health Data Notice applies to the extent that it is consistent with applicable state law. This Consumer Health Data Notice describes how The After Cancer processes consumer health data that we collect through our digital or online properties or services that link to this Consumer Health Data Notice (including as applicable, our website, social media pages, blogs,, marketing activities, live events and other activities described in this Consumer Health Data Notice (collectively, the “Service”)).
Sometimes we work with other organizations, such as doctors’ offices, hospitals, cancer centers, life science companies, patient advocacy organizations, and foundations (collectively, “Partner Organizations”). Our use of information that we process solely on behalf of our Partner Organizations is governed by our agreements with such Partner Organizations, and not this Consumer Health Data Notice. For questions about the use of consumer health data from a Partner organization, please direct your concerns to that Partner Organization.

WHAT CONSUMER HEALTH DATA WE COLLECT
When you use The After Cancer platform or sign up for services, we may collect information that qualifies as consumer health data, such as:

Your cancer diagnosis and type

Treatment history (e.g., chemotherapy, surgery, radiation)

Symptom information or goals for recovery

Responses to onboarding questions or eligibility assessments

Health-related session preferences

Interaction data (e.g., content viewed, group sessions attended)
We do not collect or process insurance information.
HOW WE USE YOUR CONSUMER HEALTH DATA
We use your consumer health data to:

USE AND DISCLOSURE OF YOUR CONSUMER HEALTH DATA WITHOUT YOUR AUTHORIZATION:
The following categories describe different ways that your Consumer Health Data may be disclosed without your authorization.

Partner Organizations, as that term is defined above.

Marketing and Advertising:. We may use your Consumer Health Data for any marketing communications to you about a product or service that encourages you to use or purchase the product or service. However, we must notify you if the marketing involves financial remuneration.

For Research: We may disclose your Consumer Health Data for the purpose of research, whether commercial or non-commercial in nature, subject to the conditions noted herein. We will only disclose your Consumer Health Data for research purposes upon your express authorization or if the research protocol has been approved by an institutional review board that has reviewed the research proposal and established protocols to ensure the privacy of your Consumer Health Data. The restrictions stated herein do not apply to instances where data related to you, or your care has been anonymized so that your identity is not capable of being determined from the data.

To Avert a Serious Threat to Health or Safety: We may use and disclose your Consumer Health Data when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.

Military and Veterans: If you are a member of the armed forces or separated/discharged from military services, we may release your Consumer Health Data as required by military command authorities or the Department of Veterans Affairs as may be applicable. We may also release consumer health data about foreign military personnel to the appropriate foreign military authorities.

Workers’ Compensation: We may release your Consumer Health Data as authorized by, and in compliance with, laws related to workers’ compensation and similar programs established by law that provide benefits for work-related illnesses and injuries without regard to fault.

Public or Private Health Activities: We may disclose your Consumer Health Data for public or private health activities. These activities generally include the following:

to prevent or control disease, injury, or disability;

to report births and deaths;
-
to report child abuse or neglect;
-
to report reactions to medications or problems with products; to notify people of recalls of products they may be using;

to notify third parties required to receive information on FDA-regulated products; and
-
to notify a person who may have been exposed to a disease or may be at risk for contracting or spreading a disease or condition.
8. Lawsuits and Disputes: If you are involved in a lawsuit or a dispute, we may disclose your Consumer Health Data in response to a court or administrative order. We may also disclose your Consumer Health Data in response to a subpoena, discovery request, or other lawful process by someone else involved in the dispute, but only if efforts have been made to tell you about the request or to obtain an order protecting the information requested.
9. Law Enforcement: We may disclose your Consumer Health Data to law enforcement officials for law enforcement purposes including the following:

in reporting certain injuries, as required by law, gunshot wounds, burns, injuries to perpetrators of crime;

in response to a court order, subpoena, warrant, summons or similar process;

to identify or locate a suspect, fugitive, material witness, or missing person;

about the victim of a crime, if the victim agrees to disclose or under certain limited circumstances, we are unable to obtain the person’s agreement;

about a death we believe may be the result of criminal conduct;

about criminal conduct at our facility; and in emergency circumstances to report a crime; the location of the crime or victims; or the identity, description, or location of the person who committed the crime.
10. Organ and Tissue Donation: We may disclose your Consumer Health Data to organizations involved in the procurement, banking, or transplantation of cadaveric organs, eyes or tissue, to facilitate organ and tissue donation where applicable.
11. Abuse, Neglect and Domestic Violence: We may disclose your Consumer Health Data to an appropriate governmental authority if your Telehealth Provider reasonably believes that you may be a victim of abuse, neglect, or domestic violence. We will only make this disclosure if you agree or when required or authorized by law.
12. Coroners, Health Examiners and Funeral Directors: We may disclose your Consumer Health Data to a coroner or health examiner. This may be necessary, for example, to identify a deceased person or determine the cause of death. We may also disclose your Consumer Health Data to funeral directors as necessary to carry out their duties.
13. National Security and Intelligence Activities: We may disclose your Consumer Health Data to authorized federal officials for intelligence, counterintelligence, and other national security activities authorized by law, or for the purpose of providing protective services to the President or foreign heads of state.
14. Inmates: If you are an inmate of a correctional institution or under the custody of a law enforcement official, we may disclose your Consumer Health Data to the correctional institution or law enforcement official. This release would be necessary (a) for the institution to provide you with health care; (b) to protect your health and safety or the health and safety of others; or (c) for the safety and security of the correctional institution.
WE MAY NOT USE OR DISCLOSE YOUR CONSUMER HEALTH DATA FOR THE FOLLOWING PURPOSES WITHOUT YOUR AUTHORIZATION:

We must obtain an authorization for any disclosure of your Consumer Health Data which constitutes a sale of Consumer Health Data, unless the information disclosed which relates to you or your care has been anonymized so that your identity is not capable of being determined from the data.

We must obtain an authorization for all other uses and disclosures of your Consumer Health Data not described in this Notice. If you provide us with written authorization to use or disclose your Consumer Health Data, you may revoke that authorization, in writing, at any time, by addressing a letter to our Privacy Officer at the physical address listed on the first page of this Notice.
CHANGES TO THIS NOTICE:
We reserve the right to change our Consumer Health Data Notice and any terms of this Notice. If our Consumer Health Data Notice materially changes, we will revise this Notice and make copies of the revised Notice available upon request and through The After Cancer Platform. We reserve the right to make the revised or changed Notice effective for Consumer Health Data we already have about you as well as any Consumer Health Data we receive in the future.
TO MAKE A COMPLAINT:
If you believe your privacy rights have been violated, you may file a complaint with us or with the Secretary of the United States Department of Health and Human Services. To file a complaint with us, send a written Notice of your concerns to our Privacy Officer at the physical address listed on the first page of this Notice. There will be no retaliation against you for filing a complaint.

We may update this Consumer Health Data Notice from time to time. The most recent version of the Consumer Health Data Notice is reflected by the version date located at the top of this Consumer Health Data Notice. We encourage you to review this Consumer Health Data Notice often to stay informed of how we may process your information. If we have the ability to do so (e.g., if you have an active account, or we have contact information for you), we will attempt to notify you of any material changes to our Consumer Health Data Notice that impact your Personal Data.
